Returns

The consumer has the right to to 14 days for any reason, return the goods. This is done so that the company in writing to withdraw from the contract, at the contact e-mail. The form of the withdrawal can be found here. The consumer must return the goods to the company within thirty days after the written notification of withdrawal to the consumer from buying in that it shall bear the direct cost of returning. Goods must be intact and unused in original packaging. It is accompanied by a copy of the contract. The landlord returns the entire purchase price with the cost of delivery as soon as possible, but not later than 14 days after receipt of notice of withdrawal from the consumer's purchase.

RETURN OF GOODS SUCH AS COMPLAINT

If items bought online at ActionMama do not correspond to the characteristics promised by the seller or if the seller sent the wrong items (ammount, the color of the goods or other deviation from the customer's order), the customer can return the items.

RETURN OF DAMAGED GOODS

In the event that the package is physically damaged, it lacks parts of content or showing signs of package opening, the customer must initiate the process of complaint at the Post of Slovenia or at the company DPD. We will ensure that the complaint is resolved as soon as possible.

NON-CONFORMITY OF GOODS

The buyer may exercise their rights regarding the non-conformity of goods if they notify the seller of the non-conformity within two months from the date on which the non-conformity was discovered. The notification must include a precise description of the non-conformity, and the buyer must allow the seller to inspect the goods.

The right to exercise claims arising from the non-conformity of goods is more precisely regulated by the provisions of the Consumer Protection Act (ZVPot-1, 26 January 2023).

The seller is not liable for any non-conformity of the goods that appears after two years from the date of delivery. It is presumed that a non-conformity already existed at the time of delivery if it becomes apparent within one year of delivery.

A buyer who has duly notified the seller of a non-conformity of the goods has the right to request the seller to:

  • remedy the non-conformity (repair), or
  • replace the non-conforming goods with new, faultless goods.

Only if the seller cannot ensure repair or replacement with new goods may the buyer request a proportionate reduction of the purchase price or a full refund (withdrawal from the contract).

In the event of a non-conformity that appears within 30 days of delivery, the buyer has the so-called right of rejection—in this period, they may withdraw from the sales contract and request a refund without first having to request repair or replacement of the goods.

A non-conformity of goods exists when:

  • the item does not possess the qualities necessary for its normal use or circulation,
  • the item does not possess the qualities necessary for a particular use for which the buyer is purchasing it, and which was known or should have been known to the seller,
  • the item does not possess the qualities and features that were expressly or implicitly agreed upon or prescribed,
  • the seller has delivered an item that does not match the sample or model, unless the sample or model was shown for information purposes only.

The buyer must complete the relevant form and notify the seller of the non-conformity within the statutory period. The buyer may notify the seller of the non-conformity by email, providing a precise description of the non-conformity, or in person at seller’s retail locations, where an official claim report will be completed.
